Definitions

Warranty

MIC&S, Inc. makes no warranties of any kind, whether expressed or implied, including any implied warranty of merchantability or fitness of this service for a particular purpose or audience. MIC&S, Inc. takes no responsibility for damages suffered by the User including, but not limited to, loss of data from delays, nondeliveries, misdeliveries, or service interruptions caused by MIC&S, Inc’s own negligence or the User's errors and/or omissions.

Termination

MIC&S, Inc. reserves the right to terminate the subscription (account), without refund, of any person violating the Acceptable Use Policy in whole or in part. MIC&S, Inc. will make the sole and final determination as to whether a customer has violated the Acceptable Use Policy of MIC&S, Inc.

The User has a 30 day money back period as defined in the Definitions Section. After that time the User may terminate this account at any time upon written notice 30 days prior to the subscribers next billing cycle. The User is responsible for any fees incurred up to the actual termination date and a Terminataion Fee may apply. Should the User's access to the System be suspended or terminated for any reason, all fees received by MIC&S, Inc. shall be forfeited as liquidated damages.

Qualifications for Services

MIC&S, Inc. provides Internet connectivity for personal, family, and business use. MIC&S, Inc. will make the sole determination as to whether a customer qualifies for a PersonalLine™, BusinessLine™, EntrepreneurLine™, or ModemLine™ subscription.

PersonalLine™ Service

• An individual, a man or a woman, qualifies for service if the Internet subscription is for the exclusive and personal use of the individual subscribing to the service. A single login is provided. PersonalLine™ is a flat rate service. Some access delays may occur during peak usage hours.
• PersonalLine™ includes e-mail, access to the World Wide Web (WWW), FTP, Gopher sites, and news groups for information and entertainment. Access is obtained through a single login and a single e-mail address.
• PersonalLine™ use also includes home-based business use of the Internet to send and receive e-mail in response to the Users home-based business web page. (Accesses to the home page must not exceed 1000/day or 6000/week to qualify.)
• PersonalLine™ excludes non-home-based business use of any kind.
• PersonalLine™ includes 2 Megabytes of home page storage
• PersonalLine™ acounts maybe expanded to include family members at addtional cost.

BusinessLine™

• An individual businessperson, a man or a woman qualifies for BusinessLine™ service if the Internet subscription is for the exclusive business and personal use of the person subscribing to the service. A single login is provided. BusinessLine™ is a flat rate service. Slower response times and access delays times may occur during peak usage hours.
• BusinessLine™ includes e-mail, access to the World Wide Web (WWW), FTP, Gopher sites, and news groups for information and promotion of the business. Access is obtained through a single login and a single e-mail address.
• BusinessLine™ includes a home page storage area and a free Quick-Start home page.

EntrepreneurLine™

• A business qualifies for EntrepreneurLine™ service if the Internet subscription is for the exclusive business use of the business subscribing to the service. Four logins are provided. EntrepreneurLine™ is a flat rate service. Slower response times and access delays times may occur during peak usage hours.
• EntrepreneurLine™ includes e-mail, access to the World Wide Web (WWW), FTP, Gopher sites, and news groups for information and promotion of the business. Up to four e-mail addresses are provided.
• EntrepreneurLine™ includes a home page storage area, a free Quick-Start home page and two hours of consulting are included.
• MIC&S, Inc. will assist the entrepreneur in promoting the business using the Internet.
• EntrepreneurLine™ includes the use of a static IP Address and unique URL. MIC&S, Inc. assistance in obtaining a static IP and unique URL is at additional cost.

ModemLine™

• A subscriber qualifies for ModemLine™ service if the User requires a dial in line and a modem dedicated to their use. A single login is provided. Slower response times may be experienced during peak usage hours.
• ModemLine™ includes e-mail, access to the World Wide Web (WWW), FTP, Gopher sites, and news groups for information and promotion of the business. Up to four e-mail address are provided.
• MIC&S, Inc. will assist the User in promoting their home page over the Internet.
• ModemLine™ includes the use of a static IP Address and unique URL. MIC&S, Inc. assistance in obtaining a static IP and unique URL is at additional cost.

Illegal Activities

MIC&S, Inc. services may only be used for lawful purposes. Transmission of any material in violation of U.S. or state regulation is prohibited. This includes, but is not limited to, copyrighted material or material protected by trade secret. The User agrees to indemnify and hold harmless MIC&S, Inc. from any claims resulting from the User's use of this service that damages the User or another party. MIC&S, Inc. reserves the right to terminate the User's account for any inappropriate usage.

Pornographic, Obscene, or Threatening Materials

• The User agrees that he or she will not retrieve, create, store, or transmit pornographic, obscene, or threatening material using MIC&S, Inc. network access and that to do so would cause great and irreparable harm to MIC&S, Inc.
• MIC&S, Inc. employs SafeTsurf™ filters to prevent access to pornographic or obscene material on the network, however, MIC&S, Inc. can not block all pornographic or obscene material and does not claim to do so.
• The User agrees to notify MIC&S of any pornographic sites not blocked by MIC&S that he or she may discover. MIC&S will review the content and block appropriate sites. MIC&S will also forward a request to have our blocking list provider update their list to include the site.

SPAM

MIC&S, Inc. services may not be used to deliver Unsolicited Bulk E-mail (UBE). This includes, but is not limited to, mass mailings advertising the User's business ventures. Additionally, using another mail server to advertise a MIC&S hosted web site via UBE is strictly prohibited.

Additional Terms and Conditions

• Your subscription makes possible a contribution equal to 10% of the subscription price to MIC&S sponsored charities. The subscriber may select a charity from the list of groups sponsored by MIC&S or may elect to have MIC&S make the selection.
• The user's conduct shall be appropriate, polite and considerate at all times.
• The User agrees to monitor network access by minors for compliance to the Acceptable Use Policy.
• Use of any information obtained via this service is at the User's own risk. MIC&S, Inc. specifically denies any responsibility for the accuracy or quality of information obtained through our services.
• The User is limited to one (1) on-line session per login name at any one time. The User assumes full responsibility for use of their account by others to whom the User has granted access. The User may not resell account access and privileges to others.
• The User is provided a specific quantity of home page storage on MIC&S, Inc. servers determined by the services purchased. If the User exceeds that size limit, the User agrees to pay additional charges at the then current rate for excess storage.
• The User must be 18 years of age or older. If the User is under 18 years of age, then a parent or legal guardian enforce the Acceptable Use Policy. The Parent or legal guardian assumes full responsibility for this account and the actions of the minor using the account.
• The User understands and agrees that MIC&S, Inc. has no obligation to preserve or protect any rights which the User may have in any information placed on the System, and shall not be responsible for backing up information placed on the System.
• The terms and conditions found in this Acceptable Use Policy supersede all previous representations, understandings, or agreements, and shall prevail notwithstanding any variance with terms and conditions of any order submitted.
• The Acceptable Use Policy and the terms and conditions contained therein are subject to change without notice. A current copy will always be available upon request.
• The User agrees to pay for this account on or before the billing due date including any Statement Preparation Fees charged by MIC&S. If payment is not received by the due date, the account may be suspended. There is a $15.00 fee for re-activation. Termination of an account due to lack of payment does not remove the User's responsibility under this agreement to pay all fees incurred up to date canceled including any collection fees incurred by MIC&S, Inc. There is a $25.00 charge for returned checks.
• The User understands and accepts the terms of this agreement and agrees to pay for these services according to MIC&S, Inc. billing policies.
• Communication between the User and MIC&S will occur through e-mail as much as possible. When system changes and other technical or software issues occur, we will use the e-mail system to communicate with the User. It is the User’s responsibility to check mail regularly and is solely the User’s responsibility if service is interrupted because the User has not checked their mail on a timely basis.
• The Acceptable Use Policy is available for viewing on MIC&S servers. Use of MIC&S facilities and services constitutes acceptance of the Acceptable Use Policy by the User.
